While we do not sell your personal information in exchange for monetary compensation, certain sharing may be considered a “sale” under certain state laws. We may collect personal information when you interact with us or any of our brands or affiliates, such as when you:
- Access, use, visit, register through, or purchase or return goods or services via the Websites;
- Consent to receive our promotional emails, SMS/text messages, job postings or other communications;
- Provide information from your emails, texts, chats, video calls and voice calls with our representatives;
- Participate in our contests, sweepstakes or promotions, or participate in one of our surveys or other customer research;
- Submit product ratings and reviews;
- Contact us or one of our service providers with a comment, question or complaint; or
- Enroll or participate in one or more of our customer, loyalty, rewards, or other programs.
We may also collect personal information from certain third parties, such as third-party marketing providers.
We do not collect your sensitive personal information (as such term is defined under applicable state laws); therefore, we do not sell your sensitive personal information or share your sensitive personal information for purposes of cross-context targeted advertising.
We use third parties to improve our ability to identify visitors to our website. As part of this service, we may make available identifiers to these third parties including our visitors’ IP addresses, cookies, and hashed versions of email addresses captured from your visit. We, and third parties, use this data to obtain more information about our visitors and reach out to them through other channels, such as targeted ads, email, and/or direct mail. Removal may not encompass all possible locations; for example, back-ups, information in our systems for business purposes such as, transaction records and warranty information.
- Right to Correct: You have the right to change, update or correct inaccurate personal information that we maintain about you. If offered as a feature of the Websites, you may be able to edit some of the information about you.
- Right to Opt-Out: You have the right to opt-out of the sale or sharing of your personal information.

RETENTION OF PERSONAL INFORMATION
We only keep the personal information that we collect from you for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. The criteria we use to determine the retention period includes the nature of the information, the purpose for which the information was collected, and whether a legal obligation requires us to retain the information. We may also retain aggregate information for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes.
PERSONAL INFORMATION OF MINORS
We do not knowingly collect personal information directly from children under the age of thirteen (13) (or such other digital age of consent in your jurisdiction, for example, sixteen (16) years of age in certain European countries) (each a “Minor”) without parental consent. The Websites are general audience sites and are not specifically targeted to or intended for use by consumers under the age of eighteen (18). We do not knowingly collect personal information directly from known children above the age of thirteen (13) and under the age of eighteen (18) without affirmative authorization from the consumer. If we learn we have collected or received personal information from a Minor without verification of parental consent or from a known child above the age of thirteen (13) and under the age of eighteen (18) without affirmative authorization, we will delete that information. TRACKING USER ACTIVITY AND OPT-OUT PREFERENCE SIGNALS
Certain web browsers allow users to enable a Do Not Track privacy preference setting that allows users to opt out of tracking by websites and online services. There is not a common understanding of how to interpret these Do Not Track signals so our Websites do not currently respond to Do Not Track signals.
You may set your browser or device to send an opt-out preference signal, such as through the Global Privacy Control, to signal a request to opt-out of the sale or sharing of your personal information or a request to opt-out of the processing of your personal information for the purpose of targeted advertising. We will process any valid opt-out preference signal by honoring such opt-out preference signal as a request to opt-out of the sale and sharing of your personal information and/or a request to opt-out of the processing of your personal information for the purpose of targeted advertising for your browser or device and any consumer profile associated with your browser or device in accordance with applicable law. SECURITY
We have implemented reasonable security practices and procedures appropriate to the nature of each category of personal information that we collect from you to prevent unauthorized access, destruction, disclosure, modification and use or your personal information. If you create an account through the Websites, please select strong login credentials and do not share your password. This section applies to Colorado Consumers, as defined by the Colorado Privacy Act (the “CPA”), Connecticut Consumers, as defined by the Connecticut Data Privacy Act (the “CTDPA”), Florida Consumers, as defined by the Florida Digital Bill of Rights (the “FDBR”), Montana Consumers, as defined by the Montana Consumer Data Privacy Act (the “MTCDPA”), Oregon Consumers, as defined in the Oregon Consumer Privacy Act (the “OCPA”), Texas Consumers, as defined by the Texas Data Privacy and Security Act (the “TDPSA”), and Virginia Consumers, as defined by the Virginia Consumer Data Protection Act (the “VCDPA”) that use our Websites. If you are a Colorado, Connecticut, Florida, Montana, Oregon, Texas, or Virginia Consumer, subject to certain conditions and restrictions set forth in the CPA, CTDPA, FDBR, MTCDPA, OCPA, TDPSA, or VCDPA, as applicable, and other applicable laws, you may have the following rights with regard to your personal information:
- Right to Access. You have the right to confirm whether we are Processing your personal information, to access your personal information, and to ask that we provide you a copy of the personal information we have collected or processed about you in a portable and, to the extent technically feasible, readily usable format. Oregon Consumers also have the right to (i) confirm whether we have Processed your personal information and the categories of your personal information we have Processed and (ii) obtain, at our option, a list of specific third parties to which we have disclosed either (1) your personal information or (2) any personal information.
- Right to Correct. You have the right to correct inaccuracies in your personal information. If offered as a feature of the Websites, you may be able to edit some of the information about you.
- Right to Delete. You have the right to delete personal information that we have collected from or obtained about you.

RIGHTS OF CALIFORNIA RESIDENTS
This section applies to California Consumers, as defined by the California Privacy Rights Act (the “CPRA”) that use our Websites. Capitalized terms defined in the CPRA that are used in this section shall have the same meaning as in the CPRA.
If you are a California Consumer, subject to certain conditions and restrictions set forth in the CPRA and other applicable laws, you may have the following rights with regard to your personal information:

RIGHTS OF UTAH RESIDENTS
This section applies to Utah Consumers, as defined by the Utah Consumer Privacy Act (the “UCPA”), that use our Websites. Capitalized terms defined in the UCPA that are used in this section shall have the same meaning as in the UCPA.
We may Process your personal information for Targeted Advertising. You have the right to opt-out of the Processing of your personal information for Targeted Advertising , as described below.
If you are a Utah Consumer, subject to certain conditions and restrictions set forth in the UCPA, and other applicable laws, you may have the following rights with regard to your personal information:
- Right to Access. CALIFORNIA’S SHINE THE LIGHT LAW
Under California’s “Shine the Light” law (California Civil Code Section 1798.83), if you are a California resident, you may opt-out of the disclosure of your personal information to third parties for such third parties’ direct marketing purposes. You may also request that we provide you with (1) a list of the categories of information disclosed by us to third parties for such third parties’ direct marketing purposes during the immediately preceding calendar year and (2) the names and addresses of all of the third parties that disclosed your personal information to for direct marking purposes in the immediately preceding year. RIGHTS OF NEVADA RESIDENTS
We do not sell (as defined under Nevada law N.R.S. 603A.333) any Covered Information (as defined under Nevada law N.R.S. 603A.320). If we do so, we will let you know in these Notices and you will have the right to opt out of selling of certain Covered Information under Nevada law by contacting us using the contact information we provided to you below, or as otherwise provided in these Notices or the Websites. FINANCIAL INCENTIVE PROGRAMS
We provide special offers and discounts to our customers who sign up for our loyalty, rewards, or other programs, such as our VIP and Refer-a-Friend programs (collectively, our “Programs”). Customers enrolled in our Programs may earn and redeem rewards and other special offers by signing up through our website, by texting HAPPY to 30804, or by referring other customers to our website by using a Refer-a-Friend program link. To enroll in our Programs, you may be required to provide us with certain personal information, including identifiers such as your name, telephone number, and email address. If you provide your name, telephone number, and email address to enroll in our Programs, we may share such information with our vendors for targeted advertising purposes. Personal information that we collect when you enroll in our Programs may be shared with payment processors, analytics providers, and vendors that assist us with managing our Programs. Participation in our Programs is entirely voluntary. You may opt-out of our Programs by texting STOP to 30804. If you elect to exercise your right to request that we delete personal data we have collected about you, we will not be able to provide you the special offers and discounts available to customers who enroll in our Programs because we will not be able to associate your activity, such as your purchase history, with a Program profile. Under the laws of some states and other jurisdictions, including, for example, California, our Programs may be considered a financial incentive provided in exchange for the collection, retention, and use of your personal information. While we do not assign a monetary value to personal information that we collect, based on our good-faith estimate, the value of the special offers that our customers receive from the Programs is reasonably related or equal to the value we receive from the use of Program participants’ personal information. To estimate the value of Program participants’ personal information collected in connection with the Programs, we calculated the administrative costs related to providing the Programs to our Program members and collecting and retaining personal information, and the expenses related to the special offers redeemed by Program participants.
UNSUBSCRIBING FROM OUR EMAIL LIST
If you would like to unsubscribe from our email list, please contact us or use the unsubscribe link in one of our emails to you and we will remove your name from our email list. Please understand that you may receive emails between the time you request to be removed from our list and the time we are able to process your request. Email communications are not encrypted and are not considered a secure means of transmitting credit card numbers or other payment information. We will never ask for sensitive information via email.
